Terms and Conditions

1. Scope


These General Terms and Conditions (GTC) apply to all orders of goods and gift certificates, as well as to event bookings made through the Familie Reinisch GmbH online store. This offer is directed at both consumers as defined by the Austrian Consumer Protection Act (KSchG) and business entities. Any deviating terms and conditions of the customer shall apply only if Familie Reinisch GmbH has expressly agreed to their validity in writing. The version of these General Terms and Conditions published on the website at the time of the order shall apply.

3. Conclusion of the Contract


The presentation of products and services in the online store does not constitute a legally binding offer, but rather a non-binding invitation to place an order. By completing the ordering process, the customer submits a binding offer to enter into a purchase agreement. Upon receipt of the order, the customer automatically receives an order confirmation via email. This serves solely to confirm receipt of the order and does not yet constitute acceptance of the offer. The purchase contract is not concluded until an explicit order confirmation is issued or the ordered goods are shipped. In the exceptional case that an ordered item is unavailable, the customer will be notified immediately. In this case, any payments already made will be refunded immediately. The language of the contract, order, and business transactions is German.

4. Prices


All prices are in euros and include the applicable sales tax. The applicable shipping costs are displayed to the customer in the shopping cart before the order is completed. Only the prices published in the online store at the time of the order are binding. We reserve the right to correct any obvious typographical, printing, or calculation errors.

5. Payment


The available payment methods are displayed to the customer during the ordering process. The purchase price is due immediately after the order is completed, in accordance with the selected payment method. Payment processing is handled by the respective payment service providers. Their terms and conditions and privacy policies also apply. If the customer defaults on a payment, the statutory provisions regarding late payment interest and reimbursement of necessary legal costs shall apply.

6. Delivery


Delivery is available exclusively to shipping addresses in Austria and Germany. The order will be shipped to the shipping address provided by the customer when placing the order. Unless expressly agreed otherwise, the stated delivery times are non-binding estimates. In the rare event that an ordered item is unavailable or delivery is delayed for reasons beyond the control of Familie Reinisch GmbH, the customer will be notified immediately. In such cases, any payments already made will be refunded immediately. If a shipment is returned to Familie Reinisch GmbH due to an incorrect delivery address, an inability to deliver, or failure to pick up the package, the actual costs incurred for reshipping may be charged to the customer. The currently valid shipping costs and delivery terms are published on the website under “Shipping Methods.”

7. Retention of Title and Transfer of Risk


Until all claims arising from the respective order have been paid in full, the delivered goods remain the property of Familie Reinisch GmbH. For consumers, the risk of accidental loss or accidental deterioration of the goods does not pass to the customer until the goods are handed over to the customer or to a third party designated by the customer. For business customers, the risk passes to the customer upon handover of the goods to the contracted shipping carrier. If the customer has contracted the shipping carrier themselves and the carrier was not recommended by Familie Reinisch GmbH, the risk passes to the customer as soon as the goods are handed over to the shipping carrier.

8. Right of Withdrawal


Consumers are entitled to the statutory right of withdrawal under the Distance and Off-Premises Sales Act (FAGG) for distance sales contracts. Details regarding the conditions, deadlines, and legal consequences of withdrawal are set forth in the separate withdrawal policy, which is provided to the customer before the order is finalized and forms an integral part of the contract. The model withdrawal form is available on the Familie Reinisch GmbH website. To the extent provided by law, there is no right of withdrawal, in particular in the cases of exceptions regulated in § 18 FAGG.

9. Events


Familie Reinisch GmbH organizes wine tastings, culinary events, barbecue classes, and other gourmet events. Participation requires a binding registration or the purchase of a ticket. For services related to recreational activities where a specific time or period is designated for the fulfillment of the contract, there is generally no statutory right of withdrawal pursuant to Section 18(1)(10) of the Austrian Consumer Protection Act (FAGG). If an event must be canceled due to force majeure, official orders, or other unforeseeable circumstances, any participation fees already paid will be refunded. Further claims are limited to those provided for by law.

10. Warranty


The statutory warranty provisions apply.

Any obvious damage caused during shipping should be reported immediately upon receipt of the delivery to both the delivery service and Familie Reinisch GmbH. Failure to report such damage does not affect your statutory warranty rights.

Standard or minor variations in color, shape, features, or packaging, as well as vintage-related differences in wine, do not constitute a defect, provided that they do not impair the normal use or the agreed-upon quality of the goods.

To the extent permitted by law, we do not provide any warranty for damage resulting from improper storage, improper use, or normal wear and tear after the goods have been delivered.

11. Liability


Familie Reinisch GmbH is liable in accordance with the provisions of the law.

Familie Reinisch GmbH bears unlimited liability for damages resulting from death, bodily injury, or harm to health, as well as for damages caused intentionally or through gross negligence.

In the event of a breach of material contractual obligations due to slight negligence, Familie Reinisch GmbH shall be liable—to the extent permitted by law—exclusively for foreseeable damages typical for this type of contract.

Liability under the Product Liability Act remains unaffected.

To the extent permitted by law, liability for indirect damages, consequential damages, and lost profits is excluded with respect to business entities.

12. Gift Certificates


Gift certificates can be redeemed at the Familie Reinisch GmbH online store, as well as at the winery, Restaurant Thomas, and Schlafgut am Johanneshof.

Cash redemption of the gift certificate value is not permitted, to the extent permitted by law.

In the event of loss, theft, or damage to a gift certificate, there is no entitlement to a replacement.

The gift certificate terms and conditions published on the website also apply to gift certificates.

13. Protection of Minors


Alcoholic beverages will be sold only to individuals who are at least 18 years of age.

By completing the order, the customer confirms that he or she has reached the legally required minimum age and that the ordered goods will be received exclusively by adults.

Familie Reinisch GmbH reserves the right to have the contracted shipping provider conduct an age verification check upon delivery.

14. Data Protection


Personal data is processed exclusively in accordance with applicable data protection laws.

Detailed information regarding the nature, scope, and purpose of the processing of personal data, as well as the rights of data subjects, is published in the Privacy Policy on the Familie Reinisch GmbH website.

15. Force Majeure


If Familie Reinisch GmbH is unable to fulfill its contractual obligations, or unable to do so on time, due to events of force majeure, the agreed-upon delivery and performance deadlines shall be extended for the duration of the hindrance, plus a reasonable start-up period.

Force majeure includes, in particular, natural disasters, pandemics, epidemics, government measures, strikes, lockouts, operational disruptions, and other unforeseeable events beyond the control of Familie Reinisch GmbH.

If performance of the contract becomes permanently impossible, both parties are entitled to terminate the contract. In this case, any services already rendered shall be reversed immediately.

15. Final Provisions


Austrian law shall apply, to the exclusion of the conflict-of-laws rules of private international law and the United Nations Convention on Contracts for the International Sale of Goods.

For consumers, the statutory places of jurisdiction apply.

With respect to business entities, the court with subject-matter jurisdiction at the registered office of Familie Reinisch GmbH is agreed upon as the exclusive venue.

Should any provision of these General Terms and Conditions be or become invalid or unenforceable, in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid or unenforceable provision shall be replaced by the applicable statutory provision.
